Custody agreement for two under 2 while parents live in different states?

I'm planning on filing for custody for my kids jst to have an agreement w/their father on paper he will live in california while I will be living in texas w/my two babies. While the father & I were tgtr I would stay home & he works in the oilfield therefore there was no need for me to work but now that we're heading our separate ways I don't have a job.. & as for ' child support' that will be settled out of court..My question is since I don't have a job yet what are the chances that the judge will give the father primary custody..
